ouch. there is always uncertainty, all steps of this gc process :(

thanks for the note. I only hope they 'go after' people if they suspect fraud or out of status or salary issues etc.

We are just a widget/number to uscis adjudicator. All of these ability to pay denials were very scarce prior to 2004. However, in 2003 and 2004 a lot of the 245i labors got approved (gas stations, restaurants, etc.). USCIS started to see a lot of bogus companies filing for people. They decided to clarify in a memo how they were going to look at ability to pay. Now; ability to pay was used rarely, in those cases that didn't look genuine (if you go to AAO decisions you would have seen the type of companies that uscis usually went after). However, to combat the 245i labors they started to apply the memo to all companies. Just imagine that a company with $20 million revenue can get ability to pay denials; but a company with $15,000 in revenue can get approval.

Let us be honest. A lot of us who came through body shops had to pay lawyer fee or had to take a cut in pay. Many of us had to sit in the bench for a long time with out pay. At the end of the day, not all of us are the best and the brightest but we are ready to work harder than the average Joe. With or without us this country will go forward. We are here to get a greencard and to become part of the melting pot. Please admit it my friends. I fully understands why many Americans are against us. We simply take their job. Then we insult them. Then we say, if we go back the American economy will go to hell. The companies are here for cheap labor. The congressmen who support them are the biggest receivers of their contribution. That is the reality. Let us not forget that. :D

When did we ever insult americans ? that is purely a figment of your own imagination. If we did we wouldnt have the face to ask for reforms to the GC process the way we are doing now. We never claimed america would collapse if we departed .. but make no mistake we DO make a HUGE contribution to this country, disproportionate to our relative numbers. Low wage bodyshops are the bad apples; that is hardly representative of the EB-H1B community at large. And it is highly cynical of you to believe congressmen initiate reforms solely for contributions; while that is a factor, it can never be the sole one. The american electorate is there to give them the boot next time they ask for their votes. You still have a lot to learn about how the world works my friend.

I don't think there is any point in continuing this discussions. He is right in his own way. You are right in your own way.
He is concerned about porting across the categories. What you mentioned is the valid point but the affected person will still be able to port with in the category.

Not just EB3 to EB2 port but EB2 to EB2 as well. Consider you lose your present job and lose your entire GC process. When you find a new job(if any), you would want to port your old PD at your new employer when they file your fresh 140.

So no one is immune, if you think you are, you are ignorant and do not know how complex a case can become.

There are very few benefits that CIS provides for people who lose jobs and PD portability is one of them. enlighten yourself!

Three mischievous old Grandmas were sitting on a bench outside a nursing home...

... when an old Grandpa walked by. And one of the old Grandmas yelled out saying, "We bet we can tell exactly how old you are." The old man said, "There is no way you can guess it, you old fools."

One of the old Grandmas said, "Sure we can! Just drop your pants and under shorts and we can tell your exact age."

Embarrassed just a little, but anxious to prove they couldn't do it, he dropped his drawers.

The Grandmas asked him to first turn around a couple of times and to jump up and down several times.

Then they all piped up and said, "You're 87 years old!"

Standing with his pants down around his ankles, the old gent asked, "How in the world did you guess?"

Slapping their knees and grinning from ear to ear, the three old ladies happily yelled in unison - - "We were at your birthday party yesterday!"

    still trolling Lou.

You can feel the vengence of Lou against immigrants in the tone, in the voice in the tenor and above all in the content and subject matter.

I can't sit quietly if someone on this forum speaks highly of Lou. But soon we must end this discussion, if Communique continues his rant. We need other things on the forum, like sending web fax #15, following senate live discussions. Such bill comes up only once in one's lifetime.

"Folks, please be more rational and thoughtful please ?"

I think thoughtful and rational are NOT two words you would use to describe a Lou Dobbs broadcast. :D

Extremely one sided, hateful, demagogry, those words would be more accurate.

Democrats Should Read Kipling (http://www.nytimes.com/2008/02/18/opinion/18kristol.html?ref=opinion) By WILLIAM KRISTOL | NYT, Feb 18

Browsing through a used-book store Friday in the Milwaukee airport, of all places I came across a 1981 paperback collection of George Orwells essays. Thats how I happened to reread his 1942 essay on Rudyard Kipling. Given Orwells perpetual ability to elucidate, one shouldnt be surprised that its argument would shed light or so it seems to me on contemporary American politics.

Orwell offers a highly qualified appreciation of the then (and still) politically incorrect Kipling. He insists that one must admit that Kipling is morally insensitive and aesthetically disgusting. Still, he says, Kipling survives while the refined people who have sniggered at him seem to wear so badly. One reason for this is that Kipling identified himself with the ruling power and not with the opposition.

In a gifted writer, Orwell remarks, this seems to us strange and even disgusting, but it did have the advantage of giving Kipling a certain grip on reality. Kipling at least tried to imagine what action and responsibility are like. For, Orwell explains, The ruling power is always faced with the question, In such and such circumstances, what would you do?, whereas the opposition is not obliged to take responsibility or make any real decisions. Furthermore, where it is a permanent and pensioned opposition, as in England, the quality of its thought deteriorates accordingly.

If I may vulgarize the implications of Orwells argument a bit: substitute Republicans for Kipling and Democrats for the opposition, and you have a good synopsis of the current state of American politics.

Having controlled the executive branch for 28 of the last 40 years, Republicans tend to think of themselves as the governing party with some of the arrogance and narrowness that implies, but also with a sense of real-world responsibility. Many Democrats, on the other hand, no longer even try to imagine what action and responsibility are like. They do, however, enjoy the support of many refined people who snigger at the sometimes inept and ungraceful ways of the Republicans. (And, if I may say so, the quality of thought of the Democrats academic and media supporters a permanent and, as it were, pensioned opposition seems to me to have deteriorated as Orwell would have predicted.)

The Democrats won control of Congress in November 2006, thanks in large part to President Bushs failures in Iraq. Then they spent the next year seeking to ensure that he couldnt turn those failures around. Democrats were against the war and the surge. That was the sum and substance of their policy. They refused to acknowledge changing facts on the ground, or to debate the real consequences of withdrawal and defeat. It was, they apparently thought, the Bush administration, not America, that would lose. The 2007 Congressional Democrats showed what it means to be an opposition party that takes no responsibility for the consequences of the choices involved in governing.

So it continues in 2008. The director of the Central Intelligence Agency, Gen. Michael Hayden, the director of national intelligence, the retired Vice Admiral Mike McConnell, and the attorney general, the former federal judge Michael Mukasey, are highly respected and nonpolitical officials with little in the way of partisanship or ideology in their backgrounds. They have all testified, under oath, that in their judgments, certain legal arrangements regarding surveillance abilities are important to our national security.

Not all Democrats have refused to listen. In the Senate, Jay Rockefeller, chairman of the Intelligence Committee, took seriously the job of updating the Foreign Intelligence Surveillance Act in light of technological changes and court decisions. His committee produced an impressive report, and, by a vote of 13 to 2, sent legislation to the floor that would have preserved the governments ability to listen to foreign phone calls and read foreign e-mail that passed through switching points in the United States. The full Senate passed the legislation easily with a majority of Democrats voting against, and Senators Obama and Clinton indicating their opposition from the campaign trail.

But the Democratic House leadership balked particularly at the notion of protecting from lawsuits companies that had cooperated with the government in surveillance efforts after Sept. 11. Director McConnell repeatedly explained that such private-sector cooperation is critical to antiterror efforts, in surveillance and other areas, and that it requires the assurance of immunity. Your country is at risk if we cant get the private sector to help us, and that is atrophying all the time, he said. But for the House Democrats, sticking it to the phone companies and to the Bush administration seemed to outweigh erring on the side of safety in defending the country.

To govern is to choose, a Democrat of an earlier generation, John F. Kennedy, famously remarked. Is this generation of Democrats capable of governing?

    hey guys,

M new to this. I have applied for a H1 B this year ....i went thru the pdf on bill S 1035 ...& it states the following:

    Section 2(e) Prohibition of Outplacement
    1. Employer cannot place, outsource, lease, or otherwise contract for the
placement of an employee on H-1B. (This prohibits any consulting work for
    an employee on H-1B).
    2. This applies to all the application filed after the enactment of this bill.

Does it mean that all existing consulting work will also be in danger?? M a bit confused as point 2 states that it will be for all applications after the enactment of the bill. Does that affect H1-b holders frm this year itself??

Really, H1B program and employment based greencard program, that brings professionals in skilled occupation into this country to fill a shortage of skilled workers has been vindicated beyond limit. People in Eb3 visa are not our enemies most of these people are our friends. We all have friends in both categories suffering. The issue exploded because of the contents of letter drafted by pani_6. It was pitting eb2 vs eb3. We all agreed all along that entire immigration system needs to be changed but here we have a letter that says dont give visa's to eb2 because we are not getting any. That I feel is unfair because all these days these spill visa's were going to ROW and people like pani_6 were perfectly happy but once their friends from eb2 (Ind) started to get them he was crying fowl.

I think we all agreed that the letter contents were somewhat pre-baked. The letter campaign was a idea in the right direction.

And mind you, we are now very active not because EB2 is moving, but because we now have concrete proof that the system was changed this year. I had my doubts, and had been asking about it for a while now, but all of the people said, "no you are wrong, the spill-over is working as it should, and as it always has". We have just recently realized that we were being misled, and there indeed has been a change. That is the reason we are being active.

Yes, you agreed that the immigration system needs to be overhauled, but the only relief in sight is for EB2 folks.. There is no legislation that will help EB3 backlogs. Recapture will again help Eb2 folks, and given the new "pecking order" that has been wrongly put by USICS, Eb3 will never truly benefit from any of these bills.

IV has its goals, as any organization should, and we fully realize that it can't keep everyone happy. However, some of you are stopping voices of others from being heard -- which is fine too. IV is a private organization that can choose to censor or restrict some kind of activities. But when you do that, you can't hope that everyone will support the organization, and believe everything that is being told to them.

    I agree with you .
I am not asking anyone to buy or rent .. its a personal decision but if you believe that one year down the line you will get a more cheaper house and the interest rates would still be at 5 % you should think twice .

House is not an investment but a side effect of home ownership is that you will end up with a property but if you continue to rent you are sure to end up with nothing .
I disagree ... all the reports say that prices will fall down for atleast a year. house is good if you need extra space and if you get it at a correct price (atleast once it stops falling) ..I agree that timing is difficult ..but in this economy it makes sense to rent when you are on temporary status.
btw ..Renting gives you flexibility and you end up with more money in the bank !! but if you have a GC (or very close to getting it) and you get a house in bargain (or at the correct price) / and you need the space plus u intend to stay there for long long time ..then yes, buying makes sense.

but as an example ..my friend in california, who few months ago was saying that california is the best, smart people etc etc is now saying that he is giving the advice to everyone to stay away from cali ..he unfortunately is stuck because he has a house there. (major layoffs in his company is giving him stress and sleepless nights).

similarly..you need to be very cautious to buy within your means ...another friend in atlanta (businessman) bought a 1million home for 800K ..he kept on beating his own drum that he is smart and others are fools ..now his house is in foreclosure and he lost around 200K ..so u can end up with nothing when you buy a house too.
    -----------
Renting is not throwing money away..why ? for one - you get a place to stay, flexibility, maintenance / property tax paid by property owner, you can rent closer to your work and move around as per needs etc etc.. housing has its own benefits (but renting has its own too .."it is not as easy as saying renting is throwing money away" ..I have been asked to write about this in detail in the IV wiki ..will post a link here later

2007: Democrats in Control, but Thwarted (http://www.washingtonpost.com/wp-dyn/content/article/2007/12/30/AR2007123000447.html) By LAURIE KELLMAN | Associated Press, Dec 30, 2007

WASHINGTON -- It's a painful irony for Democrats: In the space of a year, the Iraq war that was the source of party's resurgence in Congress became the measure of its impotence.

By the end of the 2007, a Congress controlled by Democrats for the first time since 1994 had an approval rating of only 25 percent, down from 40 percent last spring. Then the debate over the war split the party and cast shadows over other issues, spawning a series of legislative failures and losing confrontations with President Bush.

What to do about Iraq has turned into a dissing match so far-reaching and nasty that Congress's accomplishments are seen, even by some who run it, through the lens of their failure to override Bush and start bringing the troops home.

"There is no question that the war in Iraq has eclipsed much of what we have done," House Speaker Nancy Pelosi told reporters. "If you asked me in a phone call, as ardent a Democrat as I am, I would disapprove of Congress as well."

It's not as if the new Democrat-controlled Congress did nothing during 2007.

It gave the nation's lowest paid workers their first raise in a decade, raising the minimum wage from $5.15 to $5.85 an hour in July. It will rise to $7.25 an hour in 2009.

Congress also cut in half the interest rates on federal student loans and boosted annual Pell grants for post high-school education by $260 to $4,310 in July, rising to $5,400 for the 2012-2013 school year. Bush signed the bill after initially threatening to veto it.

And just before Congress turned out the lights for the year on Dec. 19, Bush signed into law a sweeping new energy policy that requires automakers to achieve an industrywide average fuel efficiency for cars, SUVs and small trucks of 35 miles per gallon by 2020, a 40 percent jump. Some analysts said the new law will render gas guzzlers relics of the past and make farmers rivals of oil companies in producing motor fuels.

"All of us deserve credit for getting some things done," Bush said in his year-end news conference, insisting that he doesn't keep score.

But on the eve of an election year with the presidency and control of Congress at stake, many others do.

In the year's firmest push-back against the Bush administration, Congress for the first time overrode one of Bush's vetoes, on a $23 billion bill for restoring hurricane-ravaged wetlands along the Gulf Coast and other water projects. The president had protested it was filled with unnecessary projects, but 34 Senate Republicans defied him.

Democrats scored other political victories as well. Most significantly, a Democrat-led investigation revealed a troubled Justice Department and forced Alberto Gonzales, a longtime presidential friend, from the attorney general's office. Democrats also played a big role in selecting his successor, Michael Mukasey.

But the story of Congress in 2007 is more about what it failed to accomplish during a war that the public opposes and that Democrats had vowed _ but did not _ to end.

On that, they found themselves repeatedly outmaneuvered, unable to break bill-killing GOP filibusters with 60 votes in a Senate where Democrats held only what effectively is a 51-49 majority.

Plans to expand health care for 10 million children stalled. And a fragile compromise put together by Bush and liberal Democrats to provide a path to citizenship for millions of immigrants buckled with only lukewarm support from all sides.

Perhaps the most bitter pill came toward the end of the year. Democrats were forced to acknowledge that the decrease in violence in Iraq might mean that Bush's much-criticized surge buildup of troops was working.

Simultaneously, they found themselves on the defensive against Republican charges that they squandered time on the war that could have been spent getting agency budgets passed on time. As usual, what has become an annual fix to the tax code to save 20 million families an average $2,000 in extra taxes was put off until the final days before Christmas.

Predictably, Democrats and Republicans blamed each other.

Majority Leader Harry Reid called Bush's "stubbornness" and Republicans' filibuster threats "obstruction on steroids."

Republicans suggested Democrats could have accomplished big reforms on Social Security and immigration _ or even just speedy passage of the federal budget _ had it been in their election-year interests.

"I just don't think the new majority wanted to do anything significant," said Senate Republican Leader Mitch McConnell of Kentucky.

By most accounts, the window for accomplishing broad new reforms was quickly closing as the nation's political machinery rumbled into position for the 2008 presidential and congressional elections. On the ballot will be all 435 House seats and 35 of the 100 seats in the Senate.

At stake is a wider Democratic majority, big enough to govern. A cascade of retirements by Republicans in the Senate made that goal achievable. Democrats hoped gain seats in the House, as well.

So they labored to tout what they had accomplished in the majority. They suggested that what failed this year might pass with more Democrats elected next year.

Bush has signed into law other initiatives of the Democratic-led Congress, such as $3 billion in funding for Louisiana's Road Home program to rebuild housing stock destroyed by Hurricane Katrina.

Procedural and institutional reforms became law as well, such as changes in ethics and lobbying rules.

Behind the scenes, Democrats and their aides debated which fights to pick next year with a lame duck president. Most likely, they said: the children's health care bill.

Immigration reform, however, appears dead until the new Congress takes its seats in 2009.

How wonderful that congress is finally introducing constructive bills to prevent 'consultants' mainly (but not only) from India from clogging up the H-1B visa system for honest skilled workers. The H-1B program is clearly intended for people WHO HAVE A SOLID FULL-TIME JOB OFFER AT THE TIME OF FILING THE APPLICATION. The whole body-shopping/visa abuse phenomenon is just disgusting. I wouldn't cry if any and all kinds of 'consultancy' activity were banned from the H-1B program. Someone stated that then they 'might as well lower the cap to 10.000/year'. Obviously not true. This bill clears out the infested issues of people illegally taking up visas on false premises. Good work!

Part of the title of this thread reads 'even H-1 renewal will be impossible'. That is just priceless. No, H-1B renewal will be impossible IF YOU ARE NOT HERE BASED ON HONEST CIRCUMSTANCES. Anyone with trouble renewing H-1Bs after this bill should get a real job or leave if they are not up to that task.

I am not sure after reading your post above if you know the meaning of "consulting". To me it looks like you are focused on the narrow group that are labelled as "on-site" consultants. These are people you are hired by one company and perform their activities at a client site. Even among these people, not all have taken up jobs under false pretext.
First of all - consulting means performing work of temporary nature. It can be temporary due to any number of reasons - regular employee is on medical leave or on maternity leave, job is temp. in nature (an analogy would be that you hire a plumber to fix something in your house and you pay him either on a per-job basis or a per-hour basis) or you do not have expertise in-house to get the job done (the plumber analogy fits here too). Let me give you an example of each one of these.

Regular Employee is on extended leave
    -------------------------------------
You are the owner of a company and your office manager is going on maternity leave for 6 months. You call a temp. agency and fill the office manager's position for 6 months. If one were to go by your definition, you would either fire your regular employee and hire a new one or you would hire the second person and fire him/ her when the regular employee is back or you would pay both of them wages

    Job is temp. in nature
    ---------------------
You are the IT manager in a big company and you have been asked to develop a new software application. To develop this application, you require 5 developers and 2 dbas over a period of 6 months. After the application is developed, you need only 2 developers and 1 dba to maintain the application. If one were to go by your logic, you would fire 3 developers and 1 dba after the application has been developed after 6 months. Or - you would just keep all of them on the payroll and the 3 developers and 1 dba will just be coming to the office and doing nothing. If you are really smart, you will hire 2 developers and 1 dba full time and call a temp. agency to fill the other 4 positions on a temp. basis.

You do not have the expertise in-house to get the job done
    ----------------------------------------------------------
You are the President of a large University and as part of local zoning laws, you need to make sure that your Heating, Ventilation and AC system (HVAC) meets the prescribed design and safty regulations. Going by what you just said, you would hire a person to make sure that everything is in order and submit the findings to the local board and then fire the person after the local zoning commision has cleared your university (one would question how you became the University President in the first place - but that is a totally different story). The other thing to do would be to call a certified Engineering company who specialize in this field and get them to do the job.

If you want to shut down a system because there are some bad apples, then all I can say is that you have a closed mind and you are not willing to think beyond what you see. You would be a classic example of a person whose H1B should not be renewed - if infact you are here on a H1B. If you are not, then I am sure that you will find more support in forums like NumbersUSA.

Guys you are unnecessarily raking your brain over this. This is a blatant anti immigrant anti eb green card bill disguised as h1 reform. The people who wrote this bill are the same people who were carrying placards saying "legal immigrants welcome, no to illegal immigration". Now do you really believe them? Even Jeff sessions was one of them and he is the number one opposer of legal eb immigrants.

Oh ok. Sorry, I was not sure about the message of your earlier post.

And for this purpose, the provisions which seem to be protecting H1 employees are actually falling short of providing any protection to make H1 program more efficient. At the same time, the bill is imposing so many restrictions that it would make the entire H1 program "non-workable" and "useless", as highlighted by the administrator.

ouch. there is always uncertainty, all steps of this gc process :(

thanks for the note.

Infanticide happens among muslims too, look at the way they treat their own women and produce dozens of children. The islamic laws make women virtual slaves of men.
We should work for putting an end to this. These are bad practices carried out in the name of religion against members of the same religion. It is not cross-border terrorism.

Though I strongly disagreed with some points made by the initial poster, some of your points look like they are out of the VHP's handy book. Muslims do have a slightly higher fertility rate, this is falling fast and there is only a slight difference between hindus and muslims. Partly it has to do with religion but there are various other reasons including higer female numbers and better mortality rate.
